Terms of service
These terms are an agreement between Cruzetec Solutions, a partnership firm,
Mohali (SAS Nagar), Punjab, India, trading as DxCS Labs ("we"), and the organisation
that uses ServerPulse at servertorch.com ("you"). Using the service means you accept them on
behalf of that organisation, and that you are authorised to.
1. The service
ServerPulse checks websites and servers you nominate and reports what it finds. It makes requests to those addresses on the schedule you set and — where you install the agent — receives reports from software running on your own server. It is a monitoring and reporting tool. It does not host your site, back it up, repair it, or stop an attack before it reaches you.
2. Accounts
- Accounts are for organisations, and for people aged 18 or over acting for them.
- You are responsible for what happens under your account, including what the people you invite do.
- Keep credentials to yourself. We strongly recommend two-factor authentication or passkeys; an owner can require them for the whole company.
- Give us an email address that reaches a person. Alerts and service notices go there.
3. What you may monitor — acceptable use
Only sites and servers you own or are expressly authorised to monitor. The service makes repeated requests to whatever you enter, inspects its TLS and headers, and — with the agent — reads files on the server. We cannot tell legitimate use from misuse at the moment an address is typed in, so the responsibility is yours, and you confirm you have that authority each time you add a site.
- The agent may only be installed on servers you control or administer with the owner's permission.
- Code audit results are shown only after you prove ownership of the site the repository belongs to (matching deployed files through the agent, or a verification file in the repository). Do not try to get around that check.
- Connect only repositories and notification channels you are entitled to use, with tokens issued to you.
You may not use the service to:
- probe, scan, load-test or monitor infrastructure you do not control or are not authorised to test;
- generate load intended to degrade a target rather than measure it;
- collect personal data about people in ways your own legal obligations do not allow — you are the Data Fiduciary / controller for your visitors' data, and you must give them the notices and obtain the consents your sites require;
- probe, attack or reverse-engineer ServerPulse itself outside our responsible-disclosure policy, or access another customer's data;
- circumvent plan limits, or resell access without our written agreement.
We may suspend an account used this way, immediately where there is a risk to others; otherwise we tell you why first. You will compensate us for third-party claims arising from monitoring you were not authorised to do.
4. Your data and ours
The monitoring data belonging to your company is yours. We use it to provide the service to you and to keep the platform itself secure, and not for anything else. How we handle personal data is in the privacy notice. For your visitors' data we are your processor, under the Data Processing Agreement, which forms part of these terms. Our current providers are listed on the subprocessors page.
5. The agent
- Installing, updating and removing it is your decision and your action. It runs with the permissions of your web server and must never be run as root.
- Commands you issue from the console are carried out by that software on your server, at your instruction, from a fixed list.
- Updates are signed; the agent refuses unsigned code. If a site token is exposed, regenerate it from the install page.
6. Plans, limits and fees
Each company has a plan with limits on sites, team members, retention and features, shown in the console; increases can be requested from the quota page. Check intervals are bounded (30 seconds at the fastest) so one account cannot consume the capacity everyone shares. Fees are as agreed when your plan is set, invoiced in Indian rupees with GST where applicable, and payable through Razorpay by the due date shown on the invoice. Unpaid invoices may lead to suspension after notice.
7. Availability and alerts
We work to keep the service running and its checks timely; the status page reports what we can observe. We do not offer an uptime guarantee unless agreed in writing. Alerts depend on things outside our control — your mail provider, your server's reachability, your configuration — so treat ServerPulse as one signal among several.
8. Ending it
You can stop at any time. An owner can delete the company from Settings → Privacy & data; after a 14-day grace period in which any owner can cancel, everything is erased except what the law requires us to keep (such as tax invoices). Export what you need before then. We may close an account that breaks section 3, abuses the platform, or is unpaid after notice; except for section 3 we give notice and time to export.
9. The service as it is, and liability
The service is provided as it is. We do not promise it will be uninterrupted or detect every problem — no monitoring tool can honestly promise that. To the extent the law allows, neither side is liable for indirect or consequential loss, and our total liability in any 12 months is limited to the fees you paid us in that period. Nothing here limits liability that cannot be limited by law, or your rights under data-protection law.
10. Law, disputes and grievances
These terms are governed by the laws of India, and the the courts at SAS Nagar (Mohali), Punjab have exclusive jurisdiction. Before going to court, write to us — most things are settled by a conversation. Complaints about personal data go to our Grievance Officer (form and contact).
11. Changes
If these terms change, the date at the top changes and company owners are emailed about anything material at least 30 days before it applies. Continuing to use the service after that means the new terms apply; if you do not agree, you can end the service under section 8.
